Terms applicable to order cancellation for custom-manufactured pouch packing machines
An order with AMS Machinery is considered confirmed when:
Once an order is confirmed, production planning, raw material procurement, and capacity allocation commence as per our manufacturing schedule.
Customers seeking to cancel a confirmed order must communicate the request in writing via email to sales@amsmachinery.in. Verbal cancellation requests are not considered valid.
Upon receipt of a written cancellation request, AMS Machinery will assess the order status and determine the applicable terms based on the stage of production. The decision in this regard rests solely with AMS Machinery and is final.
If a cancellation request is received before raw materials are procured and production has commenced, AMS Machinery may, at its sole discretion, evaluate the request. Any consideration extended will be subject to deduction of design charges, administrative fees, payment gateway charges, taxes already paid, and any other committed costs.
Once raw materials have been procured or production has begun, the order is treated as committed. Cancellation at this stage is generally not entertained, as resources, materials, and manufacturing capacity have been allocated specifically to the order.
Orders that have completed manufacturing and are ready for dispatch cannot be cancelled. The customer is required to take delivery of the machine and complete the balance payment as per agreed terms.
If a customer fails to take delivery of a manufactured machine within the agreed timeline after intimation of dispatch readiness, the following shall apply:
Manufacturing of the machine commences only upon receipt of the agreed advance. Dispatch is undertaken only after receipt of the agreed balance payment. If the customer fails to make the balance payment as per the agreed terms:
AMS Machinery reserves the right to cancel or decline an order in the following circumstances:
In such cases, AMS Machinery shall communicate the cancellation to the customer and discuss applicable remedies on a case-by-case basis.
Requests to modify an existing order — including changes in machine specification, capacity, or configuration — must be communicated in writing before the production stage. Modifications, if accepted at AMS Machinery's discretion, may attract additional charges, revised delivery timelines, and adjusted pricing.
A modification request does not entitle the customer to cancel the original order.
Cancellation of orders for spare parts or accessories is permitted only before dispatch. Once dispatched, cancellation is not possible. Standard items not specifically procured for the order may be considered for cancellation at AMS Machinery's discretion, subject to applicable deductions.
All decisions regarding cancellation, including the quantum of any consideration extended, are at the sole discretion of AMS Machinery. The decision shall be final and binding on the customer. No claim, demand, or correspondence shall be entertained beyond the final decision communicated in writing.
This Cancellation Policy is governed by the laws of India. Any dispute arising out of or in relation to this policy shall be subject to the exclusive jurisdiction of the courts in Noida / Gautam Buddh Nagar, Uttar Pradesh.
